Two Strikes....

While Dean of Harvard's law school, Solicitor General Kagan attacked military recruitment on the campus because of the "Don't Ask, Don't Tell" law. She thought it biased, though it applies to all military personnel. Now she's undermining the Federal DOMA (Defense of Marriage Act) by omitting one of the chief reasons for its necessity, ie. traditional marriage is the optimal institution in which society can raise healthy children. As SG, Kagan's job is to defend Federal Laws.
She seems to pick and choose which laws are to be upheld.
